Terms of Use - Zylo Player

1. Acceptance of Terms

By downloading, installing, or using Zylo Player ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download, install, or use the App. We reserve the right to update these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

Zylo Player is a media player application that allows users to play media content from their own IPTV subscriptions and playlists. The App supports Xtream Codes API and M3U playlist formats.

Important: Zylo Player does not provide, host, stream, store, or distribute any media content whatsoever. The App is a player tool only. All content accessed through the App is sourced entirely from third-party services and playlists provided by the user. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party content providers.

3. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you must have permission from a parent or legal guardian to use the App.

4. User Responsibilities

You are solely responsible for ensuring that you have the legal right to access any content played through the App.
You must not use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law.
You are responsible for maintaining the confidentiality and security of your device key, MAC address, and any activation codes associated with your device.
You must not attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
You must not use the App to infringe upon the intellectual property rights of any third party.

5. Subscriptions and In-App Purchases

a) Free Version

The App is available as a free download with advertisements. The free version provides access to core features with certain limitations.

b) Premium Subscriptions (Auto-Renewable)

The App offers optional auto-renewable subscription plans that unlock additional features and remove advertisements. By purchasing a subscription, you agree to the following:

Payment: Payment is charged to your Google Play or Apple App Store account at confirmation of purchase.
Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless auto-renewal is turned off at least 24 hours before the end of the current period.
Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current billing period, at the same price as the original subscription.
Managing subscriptions: You can manage and cancel your subscription at any time through your Google Play Store or Apple App Store account settings.
Cancellation: If you cancel, your subscription remains active until the end of the current billing period. No refunds are provided for partial billing periods.
Price changes: Subscription prices may change. You will be notified in advance of any price changes, and your consent will be required before the new price takes effect.

c) Refunds

All purchases and subscriptions are processed by the Google Play Store or Apple App Store. Refund requests are subject to the refund policies of the respective platform:

6. Content Disclaimer

Zylo Player is a media player application and does not host, provide, supply, or control any media content. All content accessed through the App is the sole responsibility of the user and the third-party content providers from which the user's playlists originate.

We make no representations or warranties regarding the legality, accuracy, quality, or availability of any third-party content. We are not liable for any content accessed by users through the App, including but not limited to any claims of copyright infringement, defamation, or violation of privacy.

If you are a rights holder and believe that content accessible through a user's playlist infringes your rights, please contact the relevant content provider directly, as we do not host or have access to any such content.

7. Intellectual Property

Zylo Player, including its design, user interface, code, graphics, logos, and branding, is the intellectual property of its developers and is protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and usage practices.

9. Advertisements

The free version of the App displays advertisements provided by third-party ad networks (Google AdMob). By using the free version, you consent to the display of such advertisements. Ad content is determined by the ad network provider and we have no control over the specific ads displayed.

10. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZYLO PLAYER AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Zylo Player and its developers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) shall survive.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association, or through the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Zylo Player regarding the use of the App and supersede any prior agreements.
